FAFO Farms Visitor Waiver, Agreement & Release of Liability Form
As a condition to visiting and entering onto property located at 1610 & 1650 Rossback Rd,
Davidsonville, Maryland 21035 (hereinafter referred to as “FAFO Farms”), the signatory below executes and delivers this release and waiver. I fully understand that by signing this agreement, I waive, release, and relinquish, any and all right to seek the recovery of damages for any personal injury, property damage, other cause of action, known or unknown, which may arise from my entry onto FAFO Farms and activities associated therewith.

I agree as a precondition to my participation in any event, walking path, hayride, animal
interaction, pick your own, educational activity (hereinafter referred to collectively as The FAFO
Farms Experience”) organized and/or conducted by FAFO Farms and its staff, and in further
consideration of FAFO Farms allowing me to do so, to be strictly bound by the terms of this
FAFO Farms Visitor Waiver, Agreement & Release of Liability Form (hereinafter referred to
collectively as “This Agreement”).
I, for myself and the participant(s) undersigned, acknowledge, understand, and agree that:
- Interactions with animals, including feeding of the animals and any other animal-related event, involves inherent risks that may cause serious injury, illness, or death.
- I will be asked to leave the property if anyone in my group does not follow the FAFO Farms rules and is not respectful to the animals and staff.
- FAFO Farms uses electric fencing to secure the animals on the property. There are inherent dangers associated with electric fencing. As a parent or legal guardian of a participant, I am responsible for the safety of each participant in my charge.
- Riding on a wagon pulled by a tractor is subject to sudden movements, turns and stops. I am responsible for following all verbal and written instruction and ensuring that each participant in my charge complies with the verbal and written instructions of FAFO Farms agents, employees, and staff.
- Participating in farm activities (including, but not limited to walking paths, tours, interaction with animals and pick-your-owns) is an inherently dangerous activity. It includes risks not limited to uneven ground, insect and animal bites/stings, and utilizing sharp objects (scissors, pruners and other tools used to cut stems/stalks). I understand FAFO Farms is not responsible for any injuries or harms, including but not limited to allergic reactions that may occur while on FAFO Farms property.
- I fully understand the risks and dangers associated with the FAFO Farms experience and the FAFO Farm experience of any participant and accept those risks and dangers unconditionally and know them to be inherently dangerous.
- I, for myself and the participant(s) undersigned, acknowledge and understand that all premises and equipment at FAFO Farms, including slides, stairs, structures, obstacles, walking paths, hayrides, and animal interactions can be hazardous and dangerous. Activities require various degrees of skill and experience. I understand that these activities can result in serious injury, death, illness, and loss of any kind. I understand that such risk cannot be eliminated without jeopardizing the essential qualities of the FAFO Farms Experience. I promise to accept and assume all of the risk and responsibilities for loss of any kind, injury, death, and illness to myself and the participant(s) undersigned on the FAFO Farms premises, including those that may arise out of negligence of other participants. I also hereby agree to indemnify, hold harmless and defend FAFO Farms, their employees and agents from any and all claims resulting from injuries, including death, damages and loss sustained by anyone, which arise out of or are in any way associated with my conduct or the conduct of those individuals participating under my supervision and/or the activities of the facility, I acknowledge that myself and the participant(s) undersigned may require medical assistance, which I acknowledge will be at my own expense or the expense of my personal insurers. I represent and affirm that I have adequate and appropriate insurance to provide coverage for such medical expenses.
- I am aware that there are age and weight limits of certain activities for the safety of different age groups of children at FAFO Farms.
- In consideration of FAFO Farms allowing my participation and the participation of the undersigned, I, for myself and the participant(s) undersigned and/or legal ward, heirs, administrators, personal representatives, or assigns hereby voluntarily release, waive, and forever discharge and covenant not to sue FAFO Farms and its owners, agents, employees, officers, and all other persons or entities acting on its behalf.
- I understand the effect of this waiver and acceptance of risk on my legal rights. By signing this release of liability agreement and participating at FAFO Farms, it is my intention to assume all risk of injury and I for myself and the participant(s) undersigned. I hereby fully and forever release and discharge indemnify and hold harmless FAFO Farms, its owners, employees, agents, the property owner and/or all other persons or entities acting on its behalf from any and all liabilities, claims, demands, damages, rights of action, suits or causes of action present or future, whether they be known or unknown, anticipated or unanticipated, resulting from or arising in any way out of my use or intended use of said premises, facilities or equipment to the fullest extent permitted by law. I fully and forever release and discharge the released parties and their employees and agents from any and all negligent acts and omissions in the same, and intend to be legally bound by this release to the fullest extent permitted by law.
- I consent to and authorize the use and reproduction by FAFO Farms of any and all photographs and any other audio/visual materials taken of me for marketing material, educational activities, exhibitions, or other use.
YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM AND FAFO FARMS HAS THE
RIGHT TO REFUSE TO LET YOU OR YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN
THIS FORM.
BY PLACING MY SIGNATURE BELOW, I ACKNOWLEDGE AND AGREE I HAVE READ AND
UNDERSTAND THIS AGREEMENT. I UNDERSTAND THIS DOCUMENT CONTAINS A
WAIVER OF LIABILITY, HOLD HARMLESS CLAUSE, AND COVENANT NOT TO SUE FAFO
FARMS, ITS AGENTS, OR EMPLOYEES FOR ANY AND ALL CLAIMS NOW IN EXISTENCE
OR THAT MAY ARISE AS A RESULT OF PARTICIPATION IN THE FAFO FARMS
EXPERIENCE. I ACKNOWLEDGE AND AGREE THAT I PLACE MY SIGNATURE BELOW
FREELY AND VOLUNTARILY, ON MY OWN FREE WILL, AND NOT IN RELIANCE ON ANY
PROMISE OR INDUCEMENT FROM ANY PERSON. I AGREE TO THE TERMS OF THIS
AGREEMENT, INCLUDING BUT NOT LIMITED TO THE ABOVE WAIVER OF LIABILITY AND
HOLD HARMLESS CLAUSE.
